1. Acceptance of these terms
Expungementnm.com ("the site") is operated by Land of Enchantment Law, P.C. (also doing business as Law Office of Johnn Osborn, P.C. and Expungement New Mexico), a New Mexico professional corporation. By accessing, browsing, or otherwise using the site, you acknowledge that you have read, understood, and agree to be bound by these Terms & Disclaimers and our practices regarding the limited information we collect (described in Section 7). If you do not agree, please do not use the site.
2. No legal advice
The information on this site is general information about New Mexico expungement law and related topics. It is not legal advice and is not a substitute for the advice of a licensed attorney. Every case is different. Expungement eligibility depends on the specific facts of your case, the offense at issue, the disposition, applicable waiting periods, and other details that this site cannot evaluate from the outside. Do not act or rely on any information from this site without first consulting an attorney licensed in your jurisdiction.
3. No attorney-client relationship
Use of this site — including reading our materials, downloading our PDFs, completing the eligibility quiz, submitting an online form, sending an email, leaving a voicemail, or scheduling a consultation — does not create an attorney-client relationship between you and the firm. An attorney-client relationship is formed only when the firm and the client sign a written engagement letter and the firm has confirmed in writing that it is undertaking the representation.
Until a written engagement is signed, please do not send the firm any time-sensitive information, confidential information, or information about an active criminal case beyond what is necessary to determine whether the firm can speak with you. Information you send before the firm has agreed in writing to represent you may not be treated as confidential and may not be protected by the attorney-client privilege.

4. No guarantee of results
Past results do not guarantee, predict, or assure a similar outcome in any future matter. Testimonials, case summaries, and statistical references on this site are illustrative of past work only and do not constitute a promise or warranty as to the result of any particular case. Whether and on what terms an expungement is granted is within the discretion of the court applying the New Mexico Criminal Record Expungement Act (NMSA 1978, §§ 29-3A-1 to -9) and other applicable law.
5. New Mexico practice only
The firm and its attorneys are licensed to practice law in the State of New Mexico. Nothing on this site is intended to be a solicitation to perform legal services in any jurisdiction in which the firm or its attorneys are not licensed, and the firm does not undertake representation in matters outside New Mexico except as permitted by applicable rules. By contacting the firm, you do not waive any conflict of interest that might prevent the firm from representing you.
6. Attorney advertising
This site may constitute attorney advertising under the rules of professional conduct of certain jurisdictions. The choice of an attorney is an important decision and should not be based solely on advertisements. Any communication or material you transmit to the firm through this site, by email, or otherwise — including via our contact forms and the eligibility quiz — is not confidential or privileged until the firm has agreed to represent you.
7. Information we collect
We try to collect as little personal information as possible.
- Eligibility quiz: the quiz runs entirely in your browser and produces a result without sending anything to the firm. The quiz only transmits information to the firm if you choose to enter your email and click "Send my results" — in which case your email, your quiz outcome, and the answers you selected are emailed to the firm's intake address so we can follow up.
- Contact forms and scheduling: if you book a consultation through the firm's third-party scheduling provider (currently Calendly) or submit a contact form, the information you provide is transmitted to the firm and to that provider, and is governed by that provider's privacy policy.
- Online payments: the firm uses LawPay (or a comparable IOLTA-compliant processor) for online retainer and invoice payments. Card data is collected and processed by the payment provider, not by this site. Funds for unearned fees and costs are deposited into the firm's IOLTA (client trust) account in accordance with the New Mexico Rules of Professional Conduct.
- Server logs: the firm's host may log standard request data (IP address, user agent, referrer, timestamps) for security and abuse-prevention purposes. The site does not use third-party advertising cookies, behavioral-tracking pixels, or social-media trackers.
We do not sell, rent, or trade your personal information. We use it only to respond to you, to provide legal services if engaged, and to comply with applicable law. If you would like a copy of the information we hold about you, or would like it deleted, contact the firm at expungement@landofenchantment.law.
8. Links to third-party sites
This site contains links to third-party websites, including the New Mexico Courts (nmcourts.gov), Calendly, LawPay, and other resources. The firm provides these links solely for convenience and does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any linked site. Your use of any third-party site is at your own risk and is governed by that site's terms and privacy policy.
9. Copyright and intellectual property
The content of this site — including the eligibility quiz logic, the downloadable PDF guides, the worksheet, FAQ language, and the visual design — is © Land of Enchantment Law, P.C. and is protected by U.S. copyright law. You may download and print the PDF materials for personal, non-commercial use; you may not republish, redistribute for compensation, repackage, or use the materials for the development of any competing product or service without the firm's prior written permission. "Expungement New Mexico," "Land of Enchantment Law," and the firm's logos and seal are trademarks or service marks of the firm.
10. Limitation of liability
To the maximum extent permitted by applicable law, the firm provides this site on an "as is" and "as available" basis, without warranties of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The firm does not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, and the firm does not warrant the accuracy, completeness, or timeliness of any information on the site.
To the maximum extent permitted by applicable law, the firm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the site or any information obtained from it, whether based on warranty, contract, tort, or any other legal theory, even if the firm has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the firm's liability is limited to the maximum extent permitted by law.

12. Governing law and venue
These Terms & Disclaimers, and any dispute arising out of or relating to them or to your use of this site, are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws principles. Exclusive jurisdiction and venue for any dispute lies in the state and federal courts located in Bernalillo County, New Mexico, and you consent to that jurisdiction and venue.
13. Modifications
The firm may revise these Terms & Disclaimers from time to time by updating this page. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after a revision constitutes acceptance of the revised terms. Please review this page periodically.
